These terms are the agreement between you and Die Digitalen GmbH for using Luala at luala.app and lua.la. Before every upload you confirm the points in section 4. They are the short version of what follows.
1. Who we are
Luala is run by Die Digitalen GmbH, Rautistrasse 60, 8048 Zürich, Switzerland (UID CHE-280.699.212). Write to support@lua.la and a person answers.
2. What Luala does
You upload selfies, and Luala makes photos of you from them with AI models: in the outfit, place and light you pick, and with the edits you ask for.
The photos are generated, so they are not exact. Some come out less like you than others, and a model may refuse a picture. We don't promise a likeness or a particular result. What we do promise is in section 6: you see the cost before you tap, and a photo that fails costs nothing.
3. Your account
- You sign in with Apple or Google. We get your name and email from them.
- You must be 18 or older.
- An account is for one person. You are responsible for what is made in it.
- Keep your Apple or Google account safe. Anyone who can sign in to it can use your Luala account.
4. Your selfies
Before every upload you confirm that:
- the photos show you, or someone who gave you written consent to make photos of them with Luala;
- everyone in them is 18 or older;
- there is no nudity or sexual content;
- there are no public figures, and you won't use Luala to impersonate anyone or make deceptive deepfakes.
Each confirmation is stored with the version of these terms you agreed to, the time and your language.
Every selfie is checked automatically when you save it. A photo with nudity or sexual content is refused and deleted at once.
Your selfies stay in your account until you delete them. They are deleted after 24 months without a sign-in (section 11). We never use your selfies or your photos to train AI models.
5. What's not allowed
You may not use Luala to:
- make photos of anyone who hasn't given you written consent;
- make photos of anyone under 18;
- make nude, semi-nude or sexual images, or try to get around the checks that stop them;
- impersonate a real person, or present a generated photo as a real event in a way that deceives people;
- harass, defame or threaten anyone;
- break the law or someone else's rights.
6. Credits, plans and payment
- Making a photo costs credits. Every button shows its cost before you tap it. When a photo fails, its credits come back on their own.
- Your first selfie set comes with 8 free photos, once per person.
- Credit packs are bought once. Their credits last 24 months.
- Plans renew every month or every year until you cancel. A plan grants its credits every month, on a yearly plan too. A month's credits last that month and don't carry over.
- You cancel a plan in Billing. It then runs to the end of the period you paid for. On a yearly plan we email you before it renews.
- Credits are spent soonest-expiring first. They have no cash value and can't be transferred.
- Payments go through Link, Stripe's checkout. Link sells the credits and plans to you as reseller, and its own terms for the purchase apply alongside these. Prices include tax.
7. Refunds
Within 14 days of any purchase you can get back what you paid for the credits you haven't used, in one tap in Billing. The refund guarantee has the details. It comes on top of any right to withdraw you have by law, not in place of it.
8. Your photos and what you may do with them
Every photo Luala makes for you comes with a licence for commercial use, on every plan and in the free photos alike:
- We give you every right we hold in the photo, worldwide and for good. You may use it for anything, including your business: your website, a newsletter, ads, merchandise.
- The licence is non-exclusive: Luala may make similar images for other people.
- It covers only the rights that exist. AI-generated images may not be protected by copyright at all, and we can't give you rights nobody holds.
- We keep only what we need to store your photos and show them to you.
- The licence starts when the photo is made. It stays when you cancel a plan, take a refund or delete your account. A photo we remove for breaking these terms loses it.
Commercial use has the limits section 4 and the law already set: no public figures, no impersonation or deceptive deepfakes, and no one in a photo without their written consent. The rights in a person's likeness stay with that person. If the law asks you to say that an image is AI-generated where you use it, saying so is up to you.
9. AI marking
Every photo Luala makes carries machine-readable marks that say it was made with AI: Google's SynthID watermark in the pixels and C2PA or XMP metadata in the file. There is no visible watermark.
10. Reports, removals and bans
Anyone can report a photo they believe breaks these terms. We review every report within 24 hours.
While we review, we may freeze an account: you are signed out and queued photos are refunded. If we find a breach, we may remove photos or ban the account. A ban deletes the account; we keep a copy of its photos, selfies and history for one year, only as evidence in case an authority or a court asks for it.
Every decision about your content comes by email, with the reason and the part of these terms it rests on. If you think we got it wrong, reply to that email and we'll look at it again. You can also take it to an out-of-court dispute settlement body or to a court.
11. Ending your account
- You can delete your account at any time in Settings. It happens at once: your selfies, photos and credits go, and a running plan is cancelled without a refund. Use the refund guarantee first if a purchase still qualifies.
- An account with no sign-in for 24 months is deleted. We email you 30 days before. An account with a running plan is never deleted for inactivity.
- You can download a copy of your photos, selfies and account history in Settings before you go.
12. Changes
We may change Luala: add or retire packs, change prices, change how a feature works. A price change never touches credits you already bought.
When we change these terms, the new version is published here with the date it takes effect, and earlier versions stay readable. For a change that affects you, we email you at least 30 days before it applies. Your next upload asks you to agree to the version then in force.
13. Liability
We make Luala with care, but we can't promise it is always available or free of errors.
We are liable without limit for damage we cause intentionally or through gross negligence, and wherever the law doesn't allow liability to be limited. Beyond that, our liability is excluded as far as the law allows.
14. Law and disputes
Swiss law applies, and the courts of Zürich decide disputes. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you can also go to its courts.
